1. Acceptance of Terms

By accessing and using BeautifulWalls.Ai ("the Service"), you agree to be bound by these Terms of Use ("Terms") and our Delivery & Returns Policy. If you do not agree with any part of these Terms or the Delivery & Returns Policy, including the sharing of your images with Google for AI processing and training as described in Section 4, you must not use the Service.

2. Use of the Service

  1. You must be at least 18 years old to use the Service.
  2. You are responsible for maintaining the confidentiality of your account information.
  3. You agree not to use the Service for any unlawful or prohibited activities.

3. Intellectual Property

Unless mentioned otherwise, all content, including images, text, and software, available on the Service is the property of BeautifulWalls.Ai or its licensors and is protected by intellectual property laws.

4. User-Generated Content

  1. Ownership: You retain ownership of any content you upload or generate using the Service.
  2. License to BeautifulWalls.Ai: By uploading or generating content, you grant BeautifulWalls.Ai a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, modify, adapt, publish, and distribute your content for the purposes of operating, promoting, and improving the Service.
  3. Edit With AI: License to Google for AI Processing and Training: By uploading or generating content, you also grant Google a non-exclusive, worldwide, royalty-free, perpetual license to use, process, and store your content for the purposes of providing AI-based image editing through Google Gemini Flash 2.0 and for training their AI models, as outlined in Google’s Privacy Policy. This includes both uploaded and generated images.
  4. Public Display of Generated Images:
    • Generated images (excluding your uploaded or edited images) may be displayed publicly on our website and accessible to all users.
    • Other users may view, use, or order printed versions of these generated images through our services.
  5. Restrictions on Uploaded and Edited Images: Your uploaded images and any images you edit are private and will not be displayed publicly or shared with other users without your explicit consent, except with Google(only if you choose to edit them with AI) for AI processing and training as described above.
  6. You are responsible for ensuring that your content does not infringe on any third-party rights.

5. Purchases

All purchases, including poster orders and credits, are subject to our Delivery & Returns Policy. Please review that policy for details on shipping, delivery times, refunds, and returns.

6. No Advertising

We do not display third-party advertisements on the Service. However, your images are shared with Google for AI processing and training, as described in Section 4.

7. Termination

  1. Termination by BeautifulWalls.Ai: BeautifulWalls.Ai reserves the right to terminate or suspend your access to the Service at any time, without notice, for conduct that violates these Terms or is harmful to other users.
  2. Termination by You: You may terminate your account at any time by following the account deletion process. Upon termination, we will delete all your personal data from our systems by the end of the day on which the termination occurs. This includes your account information, uploaded content, and any other associated data. Note that images shared with Google for AI processing and training may remain with Google, as per their Privacy Policy.

8. Limitation of Liability

To the fullest extent permitted by law, BeautifulWalls.Ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, including any use of your images by Google for training purposes.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

10. Changes to These Terms

We may modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date at the top of this Terms of Use.
